Summary Judgment Granted

Jack Tinney and Kim Fields, in conjunction with Kirkland & Ellis LLP, successfully obtained summary judgment in the United States District Court for the Southern District of West Virginia for SEMCO Energy Ventures, Inc. The plaintiffs alleged that SEMCO, who was previously engaged in the business of trading and marketing natural gas, had entered into an anti-competitive conspiracy in violation of the federal and state anti-trust laws. SEMCO was successful in arguing that, because it had not engaged in the business of trading and marketing natural gas since no later than April, 1999, the plaintiffs' lawsuit was barred by the statute of limitations. Accordingly, Judge Robert C. Chambers dismissed the case on the basis of the applicable statute of limitations.
