Motion for Temporary Restraining Order Grante

On February 5, 2008, the Hon. N. Edward Eagloski, Circuit Judge of Putnam County, granted the motion of Plaintiff/Applicant Lamar Clark for a temporary restraining order prohibiting the West Virginia Secondary Schools Activities Commission from enforcing its January 31, 2008 pronouncement that Lamar Clark was ineligible from participating on the Winfield High School 2007-2008 varsity basketball team.

Pursuant to this Order, the eligibility of Lamar Clark to compete on the Winfield High School varsity men's basketball team is immediately restored. Lamar Clark has also moved that the Court grant him permanent and preliminary injunctive relief by declaring that the decision of the WVSSAC regarding his eligibility be declared permanently invalid. A hearing on Lamar Clark's Motion for a preliminary injunction will be held in front of Judge Eagloski on February 13, 2008.

Sean Cook is a 1996 graduate of Winfield High School, where he was a member of the boy's basketball team for each of his four years. Cook and the Tinney Law Firm are handling the case of Lamar v. WVSSAC on a pro bono basis.
